Either a guilty man has been freed on a technicality because of a serious mistake by the judge or and innocent man was convicted on the basis of a misdirection by the judge. It sounds as if the misdirection was pretty obvious and was picked up pretty quickly, the prosecution accepted it and the conviction was thrown straight out.  COPFS were planning on appealing the sentence but where waiting for the appeal on conviction to succeed with what now appears to good reason.
